Frequently asked questions
What does an expert report include?
Scope, background, method, inspection and measurements, analysis of causes, repair valuation, conclusions and appendices, with the expert’s sworn statement or promise.
Is it valid in court?
Yes. It is made under the oath or promise required by art. 335 of the Spanish Civil Procedure Act (LEC), and the expert can confirm and explain it at the hearing.
Can I use it with my insurer or a neighbour?
Yes. The same report is used to negotiate with the insurer, the neighbour or the builder; if there is no agreement, it goes to court.
Is the report in Spanish?
Yes. To be used before a Spanish court or insurer, it is written in Spanish or Catalan.
How much does it cost?
It depends on the case. We call you, agree the price by phone and send the quote in writing, with travel itemised.
Does the expert then do the repairs?
No. Survey and repair work never go together on the same case: the report is independent of whoever repairs.
What if they do it but won't go to court to defend it?
If you have been told they will do the report, but without appearing before the judge to defend it, they are selling you something else: a technical report, not the expert report you asked for. A report is an expert report only if its author can defend what they have written before a judge (art. 347 of the Spanish Civil Procedure Act).
